ст.264 УК РФ Нарушение правил дорожного движения и эксплуатации транспортных средств.
п.1 бла-бла-бла ... повлекшее тяжкий вред здоровью ... до 2 лет.
п.2 бла-бла-бла ... повлекшее по неосторожности смерть человека .... до 5 лет.

В принципе виновность виновность водителя довольно очевидно просматривается (повторюсь, не зависимо от виновности велосипедиста/пешехода) поэтому такая статья вполне имеет место быть.

в КоАПе тоже можно какую нибудь статью найти, но это при менее тяжком исходе.

все так и есть, но только всегда выходит, что водитель не учел дорожной обстановки, что его скорость не соответствовала чему-то/тому-то и подвести дело под несчастный случай очень сложно.

ЗЫ Про скорость... эээ ну определят они, если надо будет, определят , по разлету всяких предметов, по деформации бампера, с помощью законов ньютона , по характеру повреждений пешехода (переломы, повреждений мягких тканей и т.д.)

ЗЗЫ про ст. 105 черный юмор, внимания не обращать. B)

ну тут же написано, что при "нарушении правил дорожного движения". Т.е. для того, чтобы вменили эту статью нужно указать пункт правил, который нарушил водитель. И не просто указать, а ДОКАЗАТЬ, что он что-то нарушал.

</table> Ну если он несся под 120-140, то вполне вероятно что по этим признакам признают его виновным в превышении скорости. А вот если 80, то фиг чего эти признаки дадут. Слишком разброс небольшой. Эксперты укажут - скорость была 60-80 км/ч - т.е. нарушения скоростного режима в городе (60 км/ч) небыло.
Да, кстати в Москве много мест, где разрешена скорость 80 км/ч. Например на Волгоградке, пр-те Мира, Кутузе.

Спасибо за ваши мнения по поводу произошедшего со мной инцидента. Было очень интересно узнать что и как на самом деле обстоит. Чтобы примирить спорящие стороны, выскажу мнение непосредственного участника с учетом всего, что было написано выше.

Столкновение произошло в крайнем левом ряду (я как раз до него успел докрутить поперек дороги). За секунду до столкновения сместился еще левее, так что в результате удара отлетел на левую обочину дороги.

Водитель явно превышал скорость, но не на 90 - 100 км/ч, а на 30-50. Так что доказать это было бы очень проблемматично. Удар, кстати, пришелся по касательной в левый угол переднего бампера ему и в край заднего колеса мне. Не думаю, что на его бампере могли остаться сколько-нибудь существенные повреждения (ну может только грязный след от колеса).

В итоге в аварии скорее всего признали бы виноватым меня. Так что на новый вел рассчитывать смысла не было.

ЗЫЖ схему дтп нарисовать все нет времени. Как раскидаюсь с делами, сделаю и повешу в эту тему.

Ну тут вопрос непростой. Если, допустим, водитель ехал 90 по трассе "не справился с управлением" и врезался в стоящей на обочине автомобиль, то он виновен в дтп. Но формально он ничего не нарушил. Или выезжая из-за закрытого поворота врезался впереди едущую машину, или другая подобная ситуация. Смысл такой, что даже строгое соблюдение пдд, не может предотвратить аварию и водитель может оказаться виновным.

к томуже в пдд присутствуют довольно скользкие моменты, например:

9.10. Водитель должен соблюдать такую дистанцию до движущегося впереди транспортного средства, которая позволила бы избежать столкновения, а также необходимый боковой интервал, обеспечивающий безопасность движения.

хотя держать безопасную дистанцию в плотном потоке представляется довольно сложным, т.к. при увеличении дистанции до безопасной туда кто-нибудь вклинится. ну и другие подобные неоднозначные моменты, которые при желании можно притянуть к нарушению пдд.

</table> если отталкиватся от тормозного пути, то нужно учитывать тип резины, с которой ехал автомобиль, тип покрытия, на котором он оттормаживался, а так же то, что колеса блокируются не все сразу, некоторые раньше, некоторые позже. Так что скорость будет вычислена очень и очень приблизительно. Ну а если у автомобиля есть АБС, то тормозной путь вообще ничего не даст.

ну это я как пример привел. что на глаза попалось.

по теме водитель vs пешеход надо искать.
наверняка к пдд есть комментарии (впрочем как и к УК) где все по пунктам расписано, может там есть. определенная правоприменительная практика по наездам есть вполне определенная. Имхо судьям легче найти какой нибудь пункт пдд, который нарушил водитель (а такой всегда найдется), а потом судить по 264, в противном случае получаем несчастный случай. Но у нас если труп, значит кто то сядет , поэтому последний случай довольно редкий.

Сбивают в Росии по несколько тысяч человек в год (или даже больше), как правило при наезде пешеход нарушает правила и заканчивается это чаще всего для него смертью или ттп. Но я что-то незнаю случаев, что бы водителей в массовом порядке оправдывали.

статистика ДТП по Питеру
всего ДТП - 1831, по вине водителей - 1232, по вине пешеходов - 589. Массовости не наблюдается.

Вспомнил интересную историю и решил запостить сюда:
У моего отца есть друг, давно эмигрировавший в Германию. Там он женился тоже на русской эмигрантки, точнее на еврейки, но это к делу не относится. Жена его работает таксистом. И вот примерно год назад она, ехав по всем правилам, с положенной скоростью естественно, сбила девочку – негритянку, вернее будет сказать девочка сама выехала ей под колёса. С девочкой полный порядок встала, отряхнулась, пошла дальше, НО её семья подала на жену друга в суд за наезд, причинение морального ущерба, и ВНИМАНИЕ! Расовую дискриминацию. Итог: лишении прав на год, штраф, и покупка нового велосипеда для обезьянки Ещё друг отца ездил к ним извинятся с подарками.
Вот такое вот законодательство с перегибами.
